By accessing and using Frameworthy (“the Service”), you accept and agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Frameworthy provides an AI-powered image generation service using Replicate's image generation API. We store generated images to allow you to track and access your previous generations.

3. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Generate content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Generate content that infringes upon the intellectual property rights of others
• Use the Service to generate deepfakes or misleading content
• Violate any applicable laws or regulations
• Generate content that promotes discrimination, violence, or hate speech

4. Intellectual Property

You retain ownership of images you generate using our Service. However, you grant Frameworthy a limited, non-exclusive, royalty-free license to store, process, and display your generated images solely for the purpose of providing the Service to you.

The Service itself, including all technology, software, and content provided by Frameworthy, is protected by intellectual property laws.

5. Image Generation and Storage

Images are generated through Replicate's image generation API. We store your generated images on our secure servers to enable you to track and access your generations.

Generated images are stored in Convex, our backend database provider, which maintains secure data storage infrastructure. You may request deletion of your stored images at any time.

6. Payment and Subscription

The Service operates on a subscription basis. Payment is processed through Stripe. By subscribing, you agree to Stripe's terms of service and our refund policy.

Subscription fees are charged in advance on a recurring basis. You may cancel your subscription at any time through your account settings.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

8. Disclaimer of Warranties

The Service is provided “as is” without any warranties, expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, Frameworthy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the “Last updated” date.
